What is Mental Capacity?

If you or your family member are considering making an application for Lasting Power of Attorney, or a similar legal process, you may require a Mental Capacity Assessment to validate the application.

A Mental Capacity Assessment is used to determine an individual’s ability to make decisions for themselves. The Mental Capacity Act 2005 came into effect in October 2007.

The Mental Capacity Act 2005 states that a person lacks capacity if they are unable to make a specific decision, at a specific time, because of an impairment of, or disturbance, in the functioning of mind or brain.

Mental Capacity is decision specific and the Code of Practice outlines this as one of its principles.

We have over 25 years experience working within mental health/mental capacity frameworks, and regularly complete assessments for Solicitors, families, Local Authorities and other Legal Professionals around the country. We are based in Holmfirth, West Yorkshire.

Our work includes CoP3 Deputyship, Lasting Power of Attorney, Testamentary Capacity assessments. Our assessments are comprehensive, robust and cover all of the relevant legal criteria required. We are able to conduct home visits and are able to provide a negative covid test prior to each appointment.
